SMALL CLAIMS COURT

The Small Claims Court has jurisdiction for claims of damages or losses up to $35,000 (excluding interest and costs). Matters before this court include:

  

  • Contracts (breach of contract, agreement, warranty)

  • Debts (unpaid invoices, loans, credit cards)

  • Employment (terminations, wrongful dismissals)

  • Property Damage (renovations, roof leaks, foundation cracks, personal and household items)

  • Product Liability (manufacturer defects)

  • Torts (wrongs between parties, negligence, nuisance, misrepresentation)

  • Neighbour Disputes (noise, odour, tree obstruction, fence extension, retaining walls)

  • Defamation (harm to person or business reputation)

  • Occupier's Liability (breach of duty of care to others)

  • Personal Injuries (slip and falls, dog bites, abuse, threats, mental suffering)

TRIBUNALS, BOARDS AND AGENCIES

There is no monetary limit at many Administrative Tribunals, Boards and Agencies ("Tribunals"). Popular Tribunals and matters before them include:

 

  • Human Rights Tribunal of Ontario (discrimination, accommodation violations)

  • Landlord and Tenant Board (unpaid rent, behaviour, damage, maintenance, repairs, infestations, etc.)

  • Condominium Authority Tribunal (condo owner disputes with condo board)

  • Social Benefits Tribunal (OW and ODSP income support and benefits)

  • Ministry of Labour (non-union workplace violations, wages, vacation pay, leave of absence, etc.)

  • Any Professional Body with a complaint, response and disciplinary hearing process (professional misconduct, abuse, or incompetence)
